GENERAL TERMS AND CONDITIONS OF SALE (GTC) & GENERAL TERMS AND CONDITIONS OF RENTAL (GTR) — EXOBLUE (B2C)

1. DEFINITIONS

Site: ExoBlue online store. Customer: non-professional individual. Product: exoskeleton(s) and accessories. Order: online purchase. Rental: temporary provision at Rental Point(s). Rental Point(s): authorized ExoBlue partner/location. Credit Card Imprint: pre-authorization of €450/item. Briefing: explanations by certified person. Inventory: assessment at handover and return.

2. SCOPE — ACCEPTANCE

These GTC/GTR govern (1) online sales in France and Europe, and (2) on-site rental in France only. Acceptance occurs before validating an order (GTC) or signing the rental agreement (GTR). Validation of the order or electronic signature of the rental agreement implies unreserved acceptance of these GTC/GTR. The GTC/GTR in force on the date of the act apply.

 

A. GENERAL TERMS AND CONDITIONS OF ONLINE SALE (GTC)

3. PRE-CONTRACTUAL INFORMATION

The Customer acknowledges having received essential information: characteristics, price, delivery, seller's identity, payment, withdrawal, legal guarantees, mediation.

4. PRODUCTS — USE — SAFETY

4.1 Characteristics presented on the Site. Non-contractual visuals (possible variation in shade/presentation). 

4.2 Product nature — Use — Limitations

The ExoBlue Product is an assisted mobility equipment for leisure and comfort use.

It is in no way a medical device within the meaning of applicable regulations and is not intended to diagnose, treat, compensate, or prevent a pathology.

The Product is designed to assist natural walking movement by providing mechanical assistance to muscular effort. It does not replace the user's walking ability.

Consequently, the use of the Product is strictly reserved for individuals capable of walking independently, without human assistance.

The Product can be used for comfort, endurance, or effort support, provided the user retains functional mobility.

4.3 Fitness — Safety — User Responsibility

The Customer acknowledges having read the Product characteristics and declares to be physically fit for its use.

The Customer undertakes to read the user manual carefully and to comply with all safety instructions provided by ExoBlue.

The use of the Product is particularly not recommended in cases of:

  • balance disorders,
  • neurological pathologies or sensori-motor deficits,
  • inability to stand or initiate walking independently,
  • any medical condition incompatible with assisted walking activity.

In case of doubt about their health or the compatibility of the Product with their physical condition, the Customer is advised to consult a healthcare professional before any use.

The Customer acknowledges using the Product under their sole responsibility and being fully aware of the risks inherent in its use.

ExoBlue cannot be held responsible for inappropriate use, non-compliance with recommendations, or use despite a contraindication.

5. AVAILABILITY — PRE-ORDER

Offers valid while stocks last. In case of unavailability after ordering, ExoBlue informs the Customer and offers: a refund, an exchange/equivalent product, or an extended delay (Customer's express agreement required).

6. ORDER

6.1 Product selection → cart verification → delivery information → transport and payment method selection → validation. The Customer can correct errors before validation. An acknowledgment of receipt is sent by email. 6.2 ExoBlue may refuse or cancel an order (by refunding if payment has already been debited) in case of: suspected fraud, unpaid amount or payment incident; incorrect/incomplete address; abnormal order; unresolved prior dispute.

7. PRICE — VAT — FEES

Prices indicated in euros, including VAT. Delivery fees and options displayed before validation. Prices may be changed at any time, with no retroactive effect on validated orders. Promotional codes cannot be combined unless otherwise stated; a validated order cannot be recalculated retrospectively.

8. PAYMENT — SECURITY

Payment methods: credit card via Stripe, payment in installments via Alma (subject to eligibility). The order is processed after payment acceptance. ExoBlue does not store banking data; it is processed by payment providers.

9. DELIVERY

9.1 Main carrier: Colissimo (home/relay point). Zones: France + Europe (depending on available options at checkout). Estimated delivery times: 5 to 8 working days, which may vary depending on carriers, periods, and logistical hazards. 9.2 Transfer of risks upon physical possession by the Customer or a designated third party. 9.3 Damaged/missing package: make reservations with the carrier and contact ExoBlue within 48 hours with photos (package + Products). 9.4 In case of significant delay, the Customer may request resolution according to legal conditions after a formal notice remains without effect.

10. RIGHT OF WITHDRAWAL

10.1 Legal period of 14 days to withdraw without cause, from receipt of the goods. 10.2 Exercise via the standard form (Appendix 1). 10.3 Return of the Product no later than 7 days following the withdrawal notification. 10.4 The Product must be returned complete with accessories. The Customer's liability may be incurred in case of depreciation resulting from unnecessary handling. 10.5 Legal exceptions (unsealed goods not returnable for hygiene/health reasons) applied only if legally relevant and clearly justified.

11. REFUND (WITHDRAWAL)

Refund of payments received (excluding delivery costs) within 14 days at the latest from notification. May bedeferred until recovery of the goods or proof of shipment. Refund via the same payment method.

12. AFTER-SALES SERVICE — RETURNS OUTSIDE OF WITHDRAWAL

For any breakdown, defect or difficulty, the Customer contacts: contact@exoblue.tech. ExoBlue communicates the procedure (diagnosis, repair, exchange, return to workshop, estimated deadlines). No returns accepted without prior validation (return authorization).

13. LEGAL GUARANTEES (B2C)

The Customer benefits from legal guarantees of conformity (Art. L.217-4 et seq. of the Consumer Code) and hidden defects (Art. 1641 et seq. of the Civil Code) under the applicable legal conditions.

14. LIABILITY

ExoBlue is bound by the proper execution of the contract under legal conditions. ExoBlue's liability cannot be engaged in case of non-compliant use with the instructions/guidelines, unauthorized modification/repair, damage attributable to the Customer or a third party, or force majeure. Nothing herein excludes or limits the mandatory rights of the consumer.

15. RETENTION OF TITLE

The Products remain the property of ExoBlue until full payment of the price.

16. PERSONAL DATA

Personal data is processed according to the Site's Privacy Policy (Shopify, Stripe, PayPal, Alma, etc.). The Customer has GDPR rights: access, rectification, erasure, opposition, limitation, portability.

17. PROOF — ARCHIVING

Computerized records serve as proof, unless proven otherwise. Contracts concluded online for an amount ≥ €120 are archived for 10 years and accessible to the Customer upon request, in accordance with the Consumer Code.

18. COMPLAINTS — MEDIATION — APPLICABLE LAW

18.1 Complaints: contact@exoblue.tech — indicative internal response time: 15 days for a first response. 18.2 Consumer mediation: the Customer may resort to a mediator free of charge after a written complaint has remained unresolved. Mediator: Centre de Médiation et d’Arbitrage de Paris https://www.cmap.fr/ cmap@cmap.fr 18.3 The GTC are governed by French law. In the absence of an amicable agreement, the Customer may refer the matter to the competent court according to the rules applicable to the consumer. 18.4
Should any of the clauses of these GTC/GTR be declared null, illegal or unenforceable, in whole or in part, by a competent court, the other clauses shall remain fully valid and continue to produce their effects.

 

B. GENERAL TERMS AND CONDITIONS OF RENTAL AT RENTAL POINTS (GTR)

19. PRINCIPLES

Rental is offered in France only and exclusively on-site at the Rental Point(s).

20. ACCESS CONDITIONS — ELIGIBILITY — SAFETY

ExoBlue / the Rental Point may require: a credit card imprint of €450/exoskeleton, an identity document (visual verification by default), acceptance of safety instructions, validation of the inventory. ExoBlue may refuse rental if: the credit card imprint is refused, the Customer refuses essential instructions, the Customer's condition does not allow safe use. Recommendations: minimum age 16, use under adult responsibility for minors; morphology and weight compatible with product capabilities.

21. DURATIONS — PRICES — START/END

Available durations: 30 min / 45 min / 1 h / 1 h 30 / 2 h / 4 h / 8 h (depending on availability). Price displayed at the Rental Point (and/or on the Website for information). Start: handover + briefing + adjustments by an authorized person. End: effective return of the exoskeleton and its accessories to the Rental Point.

22. INVENTORY — HANDOVER — ACCESSORIES

An inventory is carried out at handover (assessment + possible photos) and upon return (assessment + possible photos), unless perfect condition is noted by both parties. The equipment must be returned with its accessories provided at the time of inventory. Any anomaly must be reported before leaving the Rental Point.

23. TENANT'S OBLIGATIONS — PROHIBITIONS

The Customer undertakes to: use the equipment in accordance with the briefing, instructions, and guidelines; not entrust the equipment to a third party; avoid shocks, falls, immersion; comply with communicated weather conditions of use ; immediately report any malfunction. Strict prohibitions: modification/disassembly/addition of unauthorized accessories; sub-rental, loan, transfer; extreme use (jumps, intense running, contact sports, excessive loads); medical/therapeutic use.

24. DEPOSIT — CREDIT CARD IMPRINT (€450/ITEM)

24.1 A credit card imprint of €450 is taken on site for each exoskeleton rented. 24.2 The imprint is released after inspection upon return if no incident. The time it takes for the release to appear depends on the bank and network. 24.3 ExoBlue may convert the imprint into a debit (all or part, up to €450) in case of: non-return, theft, abnormal breakage/degradation, missing parts/accessories, cleaning/restoration beyond normal use. Any retention is justified (assessment, photos, quote/invoice if applicable).

25. LATENESS — NON-RETURN — THEFT

25.1 Lateness: operational tolerance of 10 minutes; thereafter every hour started will be charged as an additional hour. Beyond that, ExoBlue may consider the equipment as not returned (after attempted contact) and apply Article 24.3. 25.2 Non-return: ExoBlue is authorized to debit the deposit up to €450. 25.3 Theft: the Customer undertakes to file a complaint within 48 hours and to provide a copy of the complaint filing. ExoBlue may debit the deposit up to €450.

26. INDICATIVE FEE SCALE — CAP €450

A transparent scale is applied, capped at €450. ExoBlue may adjust according to models while remaining within this cap. See Appendix 2 for details.

27. LIABILITY — INSURANCE

ExoBlue does not provide individual insurance to the Customer. The Customer remains responsible for their behavior and for damages caused by non-compliant use under their personal liability insurance. Financial liability towards ExoBlue is capped at the deposit (€450), except in cases of fraud, false declaration, or gross/intentional misconduct. Nothing herein limits the mandatory rights of the consumer or liabilities that cannot be excluded by law. ExoBlue reserves the right to file a complaint and claim full compensation for any prejudice suffered, including for the part exceeding the potentially applicable cap.

28. PERSONAL DATA (RENTAL)

By default: visual verification of identity, destroyed immediately after return and inspection. Exceptional retention (fraud/incident/theft): strictly limited to what is necessary, proportionate duration until file closure, then deletion unless legal obligation or litigation.

 

APPENDIX 1 — STANDARD WITHDRAWAL FORM (ONLINE SALE)

APPENDIX 2 — INDICATIVE FEE SCALE (RENTAL) — CAP €450

A. Cleaning / refurbishment: Reinforced cleaning (dirt, odors, sand, etc.): €29.90

B. Missing accessories: Battery (if applicable): €199 | Cover / pouch: €29.90 | Charger (if applicable): €69

C. Damage: Superficial scratches (fairing): €59 | Breakage of a non-structural part: €119 | Major damage rendering the equipment unfit for use: up to €450
